ALL REBUILT OR USED: ENGINES, POWERHEADS, LOWER UNITS AND PARTS ARE SOLD on an as is basis unless otherwise specified and may be exchanged for a like part if determined to be defective. Any and all returns must be authorized ahead of time by a duly authorized representative of OutboardRebuild.com and will be for store credit only--- cash refunds will not be given at any time. There are no returns allowed on any electrical components. Any authorized returns or refunds agreed upon are subject to a 20% re-stocking charge.

AT THE LOCATION SET FORTH HEREON, OutboardRebuild.com, warrants to the original purchaser (HEREAFTER THE " CUSTOMER") that each rebuilt product sold hereunder shall be free from defects and materials in workmanship for the period set forth below from the date of delivery to the customer. If the product is found by OutboardRebuild.com to be defective, such product will, at OutboardRebuild.com's sole option, be replaced or repaired at cost to OutboardRebuild.com. OutboardRebuild.com's liability (whether under the theories of breach of contract or warranty, negligence or strict liability) for its product shall be limited to repairing or replacing parts found by oms’s to be defective. IN NO EVENT SHALL OutboardRebuild.com be liable for consequential, incidental or other damages arising out of or in connection with the product. CONSEQUENTIAL DAMAGES SHALL INCLUDE, without limitation, loss of use, income or profit, or losses sustained as the result of injury (including death) to any person, or loss of or damage to property.

ALL PRODUCTS ALLEGED by the customer to be defective must be returned to OutboardRebuild.com, POSTAGE PAID. THE CUSTOMER EXPRESSLY AGREES, AT THE CUSTOMER'S EXPENSE. TO RETURN THE WARRANTED PRODUCT TO OutboardRebuild.com's PLACE OF BUSINESS BETWEEN THE HOURS OF 9:OO A.M. AND 5:00 P.M., MONDAY THROUGH FRIDAY, EXCEPT LEGAL HOLIDAYS: AT ANY OF OUR THREE FLORIDA LOCATIONS In the event that OutboardRebuild.com provides, as a courtesy to the customer, one or more free pickups or deliveries (or perform any work at any place other than the address listed above), the customer expressly agrees that such courtesy shall not constitute a waiver of the requirements of this part.

IN THE EVENT OR DEEMS WARRANTY SERVICE JUSTIFIED UNDER THE TERMS OF THIS LIMITED WARRANTY, OutboardRebuild.com shall have 30 working days from the date of actual delivery, not including the actual date of delivery of the defective or malfunctioning product to OutboardRebuild.com's 3 locations within which to provide said service and notify the Customer of completion.
 

THIS LIMITED WARRANTY DOES NOT APPLY to any product which has been subject to misuse, mishandling, misapplication, RACING USE, rust or corrosion, neglect (including but not limited to improper maintenance or failure to follow BREAK IN INSTRUCTIONS), accident, modification (included but not limited to use of unauthorized parts or attachment), nor does this limited warranty extend to any otherwise covered product on which the manufacturer's serial number has been defaced, altered or removed.

THIS LIMITED WARRANTY DOES NOT APPLY to any product which has been subject to adjustment or repair performed by anyone other than OutboardRebuild.com, without prior written authority of OutboardRebuild.com, Should the Customer allow any adjustment or repair to be performed in violation of this provision, this limited warranty shall be deemed void and OutboardRebuild.com shall be released from any and all further liability hereunder.

THIS LIMITED WARRANTY DOES NOT COVER normal wear or any damage to an otherwise covered product if the damage is the result of blockage in the fuel, oil, or cooling systems, water damage due to water entry through the carburetors, exhaust system, or is the result of submersion, or rod or piston damage caused from high RPM running, I.E. connecting rods snapped between the rod end and the wrist pin end, or pistons that have been damaged from cold seizure or damaged from pre ignition or detonation.

THIS LIMITED WARRANTY DOES NOT APPLY to any product for which the following break in instructions are not followed (unless other written instructions are given by OutboardRebuild.com to the Customer upon original delivery of the product):

5) ALL BREAK- IN INSTRUCTIONS MUST BE FOLLOWED. They can be found in the BREAK-IN BOOKLET, it was furnished to you when you signed the sales contract.

THIS LIMITED WARRANTY COVERS Engine Block, Cylinder Heads, and Moving Parts inside the Powerhead ONLY, to wit: pistons, crank shaft, rods, rod bearing, wrist pins, and wrist pin bearings. THIS WARRANTY DOES NOT cover any item not otherwise specified in this part unless specifically and expressly agreed to by OutboardRebuild.com in a seperate writing.

THIS LIMITED WARRANTY IS FOR A PERIOD OF 3 yrs from the date of delivery of the covered product to the Customer. During the 1^{ST yr} OutboardRebuild.com shall repair or replace the covered product, at its option, without cost to the Customer. During the 2^ND and 3^RD yr. OutboardRebuild.com shall be responsible for one-half of the expense of all parts and labor of the repair or replacement, at its option, with the Customer being responsible for the other half.

THE PARTIES HERETO EXPRESSLY AGREE that the Customer's sole and exclusive remedy against OutboardRebuild.com shall be for the repairs or replacement of the defective product as provided in this limited warranty.

THIS EXCLUSIVE REMEDY shall not be deemed to have failed of its essential purpose so long as OutboardRebuild.com is willing and able to repair or replace defective goods. THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE NOT EXPRESSLY SET

IN THE EVENT of any litigation initiated by either party to enforce the terms of this limited warranty venue for said action shall be in the County of the Location that performed the service.
